Beijing’s household registration reform policy: six types of situations can be settled in "public households"

  Should employees who have no room leave their collective accounts after leaving their jobs? How to solve the problem of buying a house but the original indoor staff refused to move their accounts? There is no room in Beijing, and parents are collective households. How should newborns settle in Beijing? These problems that have plagued Beijing residents will usher in solutions.

  In order to promote the innovation of the concept and mechanism of household registration management, and effectively solve the problem of household registration personnel in this city who do not have the conditions to migrate in the city for the time being, according to the regulations on household registration in People’s Republic of China (PRC), the norms for the registration of permanent residence in police stations (Trial) and other laws and policies, the Beijing Municipal Public Security Bureau, after full investigation and extensive consultation, decided to set up a "public household" in the city’s household registration police stations, which will be implemented from June 1, 2021. The specific provisions are as follows:

  I. Establishment of "public households"

  In principle, only one non-agricultural "public household" is set up in each household registration police station in the city to receive non-agricultural registered permanent residence personnel in this area who do not have the conditions for urban migration for the time being.

  Second, the "public households" settled conditions

  Meet one of the following circumstances, the city’s household registration personnel (excluding student accounts, Beijing office accounts, postdoctoral accounts and other restrictions on the transfer of household registration in the city), you can apply for "public households" to settle in the local police station:

  (1) I have to move out because of the house property transaction account, but I, my spouse or other immediate family members (other immediate family members include parents, children, (foreign) grandparents and (foreign) grandchildren. The same below) there is no legal property housing in this city, and the account cannot be moved out;

  (two) because the account must be moved out after divorce, but I, my spouse or other immediate family members have no legal property housing in this city, and the account cannot be moved out;

  (three) because the resignation account must be moved out of the original unit collective households, there is no collective households in the current unit, and I, my spouse or other immediate family members have no legal property housing in this city, and the account cannot be moved out;

  (four) because of the change of the ownership of housing transactions or the change of the right to rent public housing, the right holder of the house now applies to move out the original indoor staff, and the original indoor staff refuses to move out without justifiable reasons;

  (five) one of the biological parents of the newborn is registered in the "public household" of this Municipality, and the newborn can not declare birth registration at other addresses in this Municipality, but can declare birth registration in the "public household" where his biological parents are registered;

  (six) other special reasons in this city can not be moved in registered permanent residence city.

  Three, "public households" transfer procedures

  (a) the required documents and materials

  1. Application for entering the household. (A natural person under the age of 18 or other persons with limited capacity for civil conduct or persons without capacity for civil conduct shall be handled by his guardian on his behalf, and relevant materials on guardianship shall be provided.   2. The applicant’s Household Registration Book or Permanent Population Registration Card. If you do not move in yourself, you must also submit the power of attorney signed by the client, the resident’s household registration book or the resident’s identity card and other valid identity documents. (If the owner of the house or the lessee of the public housing applies for the relocation of the resident in the house, it is not necessary to provide the relevant identification materials of the resident.)

  3. Housing property transactions must provide relevant documents such as the House Purchase and Sale Contract, the House Ownership Certificate or the Certificate of Immovable Property Rights; If the lessee of public housing changes, a new lease contract and a description of the public housing unit shall be provided; Divorce must provide a divorce certificate, a divorce agreement filed by the Civil Affairs Bureau or a court judgment or a court mediation; Those who leave the company must provide the resignation certificate, employee social security payment records and other relevant materials that can prove that they have left the company. If there is a new unit, it is also necessary to provide a description of the non-collective households with the administrative official seal of the new unit.

  6. Other necessary materials.

  (two) the process and time limit

  1. The process and time limit for the applicant or guardian to apply for moving into a "public household"

  (1) Persons who meet the requirements of "public households" should apply to the police station where their household registration is located by the applicant or guardian;

  (2) The police station where the household registration is located shall review the materials submitted by the applicant or guardian, and if the materials are complete and accepted on the spot, the applicant or guardian shall be informed of the materials that need to be supplemented at one time;

  (3) The public security organ shall complete the audit work within 35 working days from the date of accepting the materials. If it is necessary to consult the higher authorities, the period of asking for instructions shall not be included in the processing time limit;

  (4) If the applicant meets the conditions for moving into a public household, the public security organ shall notify the applicant to go through the immigration formalities within 10 working days from the date of notification.

  2. The process and time limit for the owner of the house or the lessee of the public housing to apply for moving the resident of the house into the "public household"

  (1) the owner of the house, the lessee or guardian of the public housing shall apply to the police station where the house is located;

  (2) The police station where the house is located shall review the materials submitted by the applicant or guardian, and if the materials are complete and accepted on the spot, and the materials are incomplete, the applicant or guardian shall be informed of the supplementary materials at one time;

  (3) The public security organ shall complete the handling work within 35 working days from the date of acceptance. If it is necessary to consult the higher authorities, the period of asking for instructions shall not be included in the handling time limit;

  (4) Before making a decision on account transfer, the public security organ shall inform the persons staying in the account or their guardians, and inform them that they have the right to state and defend themselves according to law. If it is impossible to inform, the public security organ will announce it for 30 days (the announcement period is not included in the processing time limit);

  (5) If the person staying in the account or his guardian fails to make statements and arguments or move the account within 7 days after receiving the notice or after the expiration of the announcement, or if the reasons for statements and arguments are not adopted by the public security organ, the public security organ will move the account to a "public account" on its own.

  3 "public households" indoor personnel to move out of "public households" for the process and time limit

  (1) voluntarily move out of the "public household", the "public household" indoor personnel or guardians shall apply to the local police station;

  (2) After examination and approval by the public security organ, if the indoor staff of the "public household" or their spouses or minor children have legally owned houses with the conditions to settle down, the indoor staff should move out of the "public household" after being informed by the public security organ. If it is impossible to inform, the public security organ will make an announcement for 30 days (the announcement period is not included in the processing time limit). "Public households" indoor staff after receiving the notice or within 30 days after the expiration of the announcement did not make statements and arguments or did not move the account, or the reasons for statements and arguments were not adopted by the public security organs, the public security organs themselves to move the account.

  (3) The indoor staff of "public households" or their spouses and minor children have one or more sets of houses with legal property rights in our city, and all of them have the conditions to settle down. The settled people voluntarily choose the registered address of the house. If the settled people do not choose, according to the principle that the real estate address has no priority in household registration, the specific relocation settlement order is as follows: ① I am the sole right holder, and according to the date of property rights registration, choose the house registered account with the earliest registration date; 2 I share with others and choose a housing registration account with a large share; Share is consistent, according to the earliest registration date of property rights.

  4. The public security organ shall deliver it to himself or his guardian within 7 days after making the decision to transfer the account by itself. If it cannot be delivered, it can be delivered by announcement. The scope and method of the announcement should be easy for the relocated person or his guardian to know, and the announcement period is 30 days (the announcement period is not included in the processing time limit).

  5. If the relocated person or his guardian refuses to accept the decision of the public security organ to transfer the household registration, he may apply for administrative reconsideration or bring an administrative lawsuit according to law.

  Fourth, the management of "public households"

  (a) the public security organs for the "public households" indoor staff to print the "permanent population registration card", valid for 1 year. Indoor staff of "public households" should apply to the local police station for renewal of the permanent population registration card within 14 working days before the expiration of the permanent population registration card;

  (two) "public households" indoor staff need to use the "public households" home page, should apply to the local police station, the police station issued a copy of the home page stamped with the "public households" special seal;

  (three) the applicant shall ensure that the documents provided are true and accurate. If the application materials are fraudulent, the public security organ will cancel its application for relocation; If it constitutes an illegal crime, administrative criminal responsibility shall be investigated according to law. The applicant’s untrustworthy information is included in the city’s public credit information service platform.
